And this is in the end the key challenge: public confidence. This is not merely a public relations function, a creation of ad-men, something that image consultants can be hired to fix. Public confidence in a judiciary reflects farreaching sentiments of belonging, identity and – ultimately – of justice among us all. These fragile sentiments were utterly destroyed in the South African past. It remains to be seen how far we can gather them together again. (Asmal foreword to Dyzenhaus 1998, p. x)
