11th Circuit affirms dismissal of job bias claim as time barred.

Abstract

A plaintiff lost his HIV employment discrimination lawsuit because he filed after the 90-day right-to-sue period. The appeals court upheld a lower court ruling that dismissed the lawsuit after the plaintiff failed to retrieve the certified right-to-sue letter from the post office, in time. The court then established a three-day grace period for other similar cases.
